Google Files Writ Petition Against CCI at Delhi HC

Following the leak of a sensitive report relating to the competition regulator's ongoing probe into Google's Android operating system's dominance, Google has filed a writ petition with the Delhi High Court against the Competition Commission of India (CCI)

Following a complaint from two antitrust research associates and a law school student in 2018, CCI went into investigating Google in April 2019.

CCI stated that it believes Google has reduced device manufacturers' ability and incentives to develop and sell devices running alternative versions of Android by requiring them to agree to a set of policies under the Android Compatibility Commitment in order to gain access to Google's own apps like Play Store, which is in violation of Section 4(2) (b) of the FTC Act.

According to Google, a confidential interim fact-finding report filed to the CCI by the CCI Director General's office relating to an ongoing inquiry into Google's Android smartphone agreements was leaked to the press this month.

Google stated that it seeks to avoid any additional unlawful disclosures of confidential conclusions by the CCI’s investigation arm and that it has not received or reviewed this confidential report so far.

The discoveries of DG, according to the company, will be used to organize the world's knowledge and make it widely accessible and beneficial.

Word on the street is that the DG's report accused the tech giant of employing anti-competitive, unfair, and restrictive trade practices in the mobile operating system and related areas.

Therefore, the tech giant filed a writ case in the Delhi High Court seeking redress in this situation, notably contesting the breach of confidence, which hinders Google's capacity to defend itself and causes harm to Google and its partners.

The tech giant fears the DG’s report, since it leaked the tech giant’s confidential information in an ongoing case to the media all while under the CCI’s custody. The tech giant stated how it understands that protecting confidential information is a priority to any government.

It says that it’s seeking its legal right to redress and prevent any further unlawful disclosures.

It’s said that the tech giant was in full cooperation and that it had maintained confidentiality throughout the investigation process. Therefore, it expects the same level of confidentiality with any entities it engages with.

However, the DG’s report lacks the reflection of the final decision by CCI and that the report is said to be that of an interim procedural step alone.

Google has not yet had a chance to study the DG's conclusions, let alone respond to any claims, says the tech giant.

Google plays a crucial role in the daily lives of billions of people through products and services including Search, Maps, Gmail, Android, Google Play, Chrome, and YouTube.
