IT Rules Tweaks don't Expand Powers, May Ease Norms: MeitY

The Ministry of Electronics and IT (MeitY) has countered worries that its suggested revisions to the IT Rules would expand its enforcement authority, with Secretary S Krishnan stating on April 7 that the modifications are "simply clarifying in nature" and unrelated to any current removal efforts.

According to Krishnan during a media briefing, these changes are unrelated to current takedown orders, noting that the government is "constrained by statutory provisions" and "will not exceed our authority."

Krishnan stated that MeitY is willing to ease some compliance requirements under Rule 14(1) for intermediaries, following industry feedback that the suggested framework mixed up the distinctions between platforms and publishers.

The aim was not to categorize non-publishers and publishers together. “If that communication is being sent out, we will respond to it,” he mentioned.

An important suggestion being examined is the unification of several advisories and guidelines into a more coherent, organized framework.

Industry stakeholders, such as major platforms, have raised the question of whether advisories impose enforceable duties under the IT Act's terms.

"We are exploring ways to facilitate this consolidation," Krishnan stated, noting that MeitY generally engages stakeholders prior to releasing advisories and might enhance that procedure.

Krishnan recognized worries regarding increasing takedown numbers and linked this to the growth of synthetic media and deepfakes.

MeitY is currently contemplating prolonging the consultation deadline by a minimum of two weeks to gather more feedback. According to the feedback we have gotten, we are willing to adapt," Krishnan stated, indicating that additional modifications to the proposed regulations are still possible.
