India’s conclusive AI Governance Guidelines favor coordination instead of control, establishing a flexible, principle-driven framework that fosters innovation while addressing risk using pragmatic, evidence-based tools, Nasscom, the leading trade association for the IT sector, remarked on Friday, commending the updated guidelines.

The suggested structure, including the AI Governance Group (AIGG), Technology and Policy Expert Committee (TPEC), and the AI Safety Institute (AISI), facilitates efficient collaboration and a comprehensive government strategy without establishing an excessively centralized regulator.

Nasscom states that the Guidelines’ focus on having sectoral regulators take the lead in enforcement and oversight shows a conscious attempt to maintain a balance between accountability and flexibility.

"Regarding risk mitigation, the Guidelines incorporate the demand for proportionality and evidence-driven governance—voluntary actions, scaled responsibility, and a non-punitive framework for AI incidents underpin this strategy," stated the leading IT trade organization.

The approach is practical, draw lessons from real events, refine governance tools, and steer clear of regulating potential harms, it stated.

Nasscom stated that the legal reform approach aligns with our suggestion to utilize current laws, pinpoint actual deficiencies, and make specific amendments before exploring any new overarching legislation.

The non-profit trade association additionally noted that the guidelines' clear assertion that “a distinct AI law is unnecessary at this point” closely mirrors our stance.

India's ultimate AI Governance Guidelines represent the practical implementation of the balanced, innovation-focused framework that the industry, spearheaded by Nasscom, has continually advocated.
